Wonderweb Technologies Terms of Service

These Terms of Service govern your use of all services provided by Wonderweb Technologies, including web hosting, reseller hosting, email hosting, domain registration, web design, and any related products. By purchasing or using our services via our sites (www.wonderweb.host or www.wonderweb.co.zw), you agree to be bound by these terms.

1. Acceptance of Terms

By using any Wonderweb Technologies service, you confirm that you have read, understood, and agree to these Terms of Service, our Privacy Policy, SLA, and all other policies referenced herein. If you do not agree, do not use our services.


2. Scope of Services

We provide web hosting, reseller hosting, email hosting, domain registration, web design, and related services. Service details, features, and resource limits are described on our websites and in your service confirmation email. We reserve the right to modify or discontinue any service with prior notice.


3. Billing, Payments & Refunds

3.1 Payment Methods
We accept EcoCash, PayPal, PayNow, Innbucks, bank transfers, and credit/debit cards. You are responsible for any transaction fees charged by your payment provider (e.g., PayPal fees).

3.2 Billing Cycle
Services are billed monthly, annually, or per the term you select. Invoices are generated 14 days before the due date. Auto‑renewal is enabled by default; you may disable it in your client area.

3.3 Refund Policy
All sales are final. We do not offer refunds for any service, including web hosting, email hosting, domain registrations, web design deposits or completed projects, and reseller plans. Domain name purchases and renewals are non‑refundable under ICANN policy.

3.4 Price Changes
We reserve the right to change prices for services at any time. Price changes will not affect your current billing term but will apply to renewals.


4. Late Payments & Suspension

4.1 Late Fee
A late fee of 10% of the invoice amount will be added to any invoice not paid by the due date.

4.2 Grace Period
You have a 3‑day grace period after the due date to make payment without service interruption.

4.3 Suspension
If payment is not received within 3 days after the due date, your services will be suspended. During suspension, your website and email will be inaccessible, but your data remains on our servers.

4.4 Termination
If the invoice remains unpaid for 60 days from the due date, your account and all associated data (files, emails, databases) will be permanently deleted. We are not responsible for data loss after termination.

4.5 Reactivation
To reactivate a suspended account, you must pay the outstanding invoice plus any late fees. We may charge a $10 reactivation fee at our discretion.


5. Acceptable Use Policy

You agree to use our services only for lawful purposes and in a manner that does not interfere with other users or our infrastructure. Prohibited uses include, but are not limited to:

  • IRC bots, proxy scripts, anonymizers
  • Pirated software, warez, hacktools
  • High‑Yield Interest Programs (HYIP), lottery or gambling sites
  • Hate sites, hacker‑focused sites, sites promoting illegal activities
  • File‑only hosting (image or file storage not linked to an active website)
  • Cryptocurrency mining (including mining, farming, plotting)

6. Prohibited Content & Activities

The following content is strictly forbidden on our network:

  • Adult content – pornography, explicit sexual material, or adult entertainment.
  • DMCA‑infringing content – movies, music, software, or any copyrighted material that you do not own or have explicit permission to distribute. We do not allow hosting of movie, music, or software websites.
  • Child exploitation material – any content involving minors will be reported to authorities and terminated immediately.
  • Terrorist or extremist content – content promoting violence, terrorism, or illegal acts.

If we become aware of prohibited content, we will remove it and may suspend or terminate your account without notice.


7. Zero Tolerance Spam Policy

We have a zero‑tolerance policy against spam. You may not send unsolicited commercial email, bulk email, or any form of spam from our servers or referencing our services.

  • Each email account is limited to 300 emails per hour. Exceeding this limit may result in suspension.
  • Mailing lists larger than 5,000 subscribers require a VPS or dedicated server.
  • You must use SMTP authentication to send emails. The PHP mail() function is not allowed on shared hosting.
  • All marketing emails must include a working unsubscribe link, and unsubscribing must be automated.

Any account found sending spam will be suspended immediately without notice, and may be terminated.


8. Resource Usage & Fair Use

To ensure stable performance for all customers, each hosting plan has defined resource limits. Please refer to our separate Resource Usage Policy for detailed CPU, RAM, I/O, and IOPS allocations per plan.

Fair Use for “Unlimited” Features:
While we advertise unlimited bandwidth, email accounts, and domains on certain plans, these are subject to fair use. You may not use your account for:

  • Backup storage or file archiving
  • Media libraries not linked to an active website
  • Personal file storage unrelated to your website
  • Mass file distribution (file sharing, torrents)

Accounts using more than 50GB of storage may be reviewed. At least 90% of stored files must be directly linked to your active website. We reserve the right to ask you to reduce usage or upgrade your plan.


9. Backups & Data Loss

You are solely responsible for maintaining your own backups of all files, databases, and email stored on our servers. While we may perform automated backups as a courtesy, we:

  • Do not guarantee that any backup will be available or complete
  • Are not liable for any data loss, corruption, or missing files
  • Recommend you keep off‑site backups (e.g., on your local computer or cloud storage)

You may create backups via cPanel (Full Backup or manual downloads). In the event of hardware failure or data corruption, we will attempt to restore from our available backups, but this is not guaranteed.


10. Cancellation & Termination

10.1 Voluntary Cancellation
You may cancel your service at any time by submitting a cancellation request via your client area, email, WhatsApp, or phone. 30 days’ written notice is required. No refunds are given for unused time.

10.2 Termination by Wonderweb
We reserve the right to suspend or terminate your account immediately without notice for:

  • Violation of these Terms, Acceptable Use Policy, or Spam Policy
  • Non‑payment after the grace period
  • Illegal activity or content
  • Harassment or abuse of our staff

If terminated for policy violation, you forfeit any prepaid fees.


11. Limitation of Liability

Our services are provided “as is” without warranties of merchantability or fitness for a particular purpose. To the maximum extent permitted by law, Wonderweb Technologies shall not be liable for:

  • Data loss or corruption
  • Loss of profits, revenue, or business opportunities
  • Indirect, incidental, or consequential damages
  • Service interruptions due to factors beyond our control (e.g., DDoS attacks, natural disasters, third‑party network failures)

Our total liability is limited to the fees you have paid us in the month immediately preceding the event giving rise to the claim.


12. Indemnification

You agree to indemnify and hold harmless Wonderweb Technologies, its employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your infringement of any third‑party rights (including copyright or trademark)

13. Changes to Terms

We may update these Terms of Service at any time. We will notify you of material changes by email or via your client dashboard at least 30 days in advance. Continued use of our services after the effective date constitutes acceptance of the updated terms.


14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.


15. Reasonable Person Clause

These Terms cannot anticipate every possible situation. In circumstances not expressly covered, both you and Wonderweb shall act as a reasonable person would under similar conditions. This means applying common sense, fairness, and good faith to resolve issues, rather than exploiting gaps in the policy.
